By accessing this website or purchasing any digital product from Omnitive Designs, you agree to these Terms of Service.
1. Digital Products
Omnitive Designs provides digital architectural and design products including:
House plans
Architectural drawings
Quick Drawings
Design documents
Digital visualizations and other products specifically described on the website
No physical product will be delivered unless expressly stated otherwise.
2. Product Information
Each product page describes what is included in the particular purchase.
Customers are responsible for reviewing the product description, drawings, dimensions, specifications and package contents before making payment.
Items not specifically listed as included should not be assumed to form part of the purchase.
3. Payment
Payments are accepted through M-Pesa/Paybill.
An order is considered successfully paid after the payment has been received and confirmed by the ecommerce system.
Digital download access may then be provided automatically.
4. Digital Delivery
Purchased products are delivered digitally.
Customers are responsible for providing correct information during checkout and for maintaining suitable devices, software and internet access required to download or view purchased files.
If a customer has successfully paid but cannot access the purchased product, they should contact Omnitive Designs for assistance.
5. Licence to Use Purchased House Plans
Purchasing a house plan gives the customer a non-exclusive licence to use the purchased design.
A customer may use the purchased house plan for more than one building or construction project.
There is no requirement to purchase another copy of the same standard plan each time the purchaser uses it for another project.
However, purchasing a plan does not transfer ownership of the intellectual property or copyright in the design to the customer.
Kenyan copyright law expressly recognizes plans, drawings and works of architecture as protected artistic works.
6. What Customers May Do
The purchaser may:
Download and retain the purchased files for personal or business use.
Print copies required for their projects.
Use the purchased design for multiple construction projects.
Provide copies to consultants, contractors, engineers or approval professionals where necessary for projects belonging to the purchaser.
Request modifications from Omnitive Designs or another suitably qualified professional.
7. What Customers May Not Do
Unless written permission is obtained from Omnitive Designs, customers may not:
Resell the digital plan or drawing.
Upload the files to another ecommerce website.
Distribute the plan publicly.
Sell copies of the plan to third parties.
Claim authorship of an Omnitive Designs plan.
Remove copyright or ownership information for purposes of falsely representing the design as their own commercial product.
Create a competing digital plan catalogue using Omnitive Designs products.
The licence permits construction use, including repeated construction use, but does not give the purchaser the right to commercially redistribute or resell the digital design itself.
8. Site-Specific Adaptation
Standard house plans are prepared as general designs.
A purchased plan may require adaptation before construction depending on matters such as:
Plot dimensions
Site orientation
Soil conditions
Ground levels and topography
Local planning requirements
Setbacks
Structural conditions
Drainage
Available services
Climatic or environmental conditions
The customer is responsible for ensuring that the selected design is suitable for the intended site.
9. County Approval
Purchasing or downloading a house plan does not automatically guarantee approval by any County Government or other regulatory authority.
Approval requirements may vary depending on the project location, land characteristics, applicable planning requirements and nature of the development.
Additional documentation, modifications, professional certification or approvals may therefore be required.
10. Structural Engineering
Unless specifically stated in the product description, architectural house plans do not automatically include structural engineering design.
Foundation design, reinforcement, structural members and other structural elements should be reviewed and designed by an appropriately qualified professional based on actual site and project conditions.
11. Construction Responsibility
Customers should ensure that construction work is undertaken in accordance with applicable laws, approved drawings and appropriate professional advice.
Omnitive Designs is not responsible for unauthorized alterations, incorrect interpretation of drawings, improper construction practices or changes made to purchased drawings by third parties.
12. Estimated Dimensions and Quantities
Any preliminary quantities, floor areas, material estimates or cost information accompanying a product should be independently verified before procurement or construction unless expressly supplied as a professional project-specific quantity document.
13. Modifications
Customers who require changes to a standard house plan may request customization.
Modification or customization work is separate from the original digital-product purchase unless expressly included in the package.
Additional charges may apply.
14. Refunds
Digital-product purchases are subject to the Omnitive Designs Refund Policy and Return Policy.
Nothing in these Terms excludes rights that cannot lawfully be excluded under applicable Kenyan consumer law.
15. Intellectual Property
Unless otherwise stated, website content, house-plan designs, drawings, graphics, renders, branding and related digital content remain the intellectual property of Omnitive Designs or their respective rights holders.
Purchase of a digital product grants usage rights as described in these Terms and does not constitute assignment or sale of the underlying copyright.
16. Website Availability
We endeavour to keep the website and download services operational but cannot guarantee uninterrupted availability.
Temporary interruption caused by maintenance, network failure, hosting issues or other technical problems does not automatically invalidate a completed purchase.
Where a paid customer cannot access their files because of a technical problem, Omnitive Designs will make reasonable efforts to restore access or provide the purchased files through an alternative method.
17. Changes to These Terms
Omnitive Designs may update these Terms from time to time.
The latest version will be published on this website together with the applicable updated date.
18. Governing Law
These Terms are governed by the laws of the Republic of Kenya.
